Chief Justice of India (CJI) Sanjiv Khanna recently expressed concerns over the growing trend of young lawyers abandoning litigation for corporate roles or leaving the profession entirely. Speaking at a felicitation event organized by the Bar Council of India, the CJI emphasized the urgent need for structural reforms to address entry-level challenges in the legal profession.
CJI Khanna pointed out that financial instability and lack of social security deter young advocates, especially first-generation lawyers, from pursuing litigation. He stressed, "The exodus of young talent is symptomatic of structural issues in the profession. To attract bright minds, we must create a conducive environment by addressing entry barriers and ensuring support."
The CJI lauded the Bar Council of India’s recommendation for minimum stipends to young lawyers, describing it as a crucial step to provide financial stability during their formative years. "Minimum remuneration standards can help young advocates sustain the rigors of litigation without resorting to alternative careers," he said.
Highlighting the broader implications of this trend, CJI Khanna underscored the importance of a diverse legal profession in fostering democracy. He noted that lawyers play a critical role in bringing lived experiences to courtrooms, enriching judicial decision-making and ensuring democratic representation.
The CJI also stressed the symbiotic relationship between the bar and bench, stating, "Complete justice is achieved through the nuanced understanding provided by lawyers." He added that the role of lawyers as accountability checks on the judiciary should not be seen as confrontational but as essential to mutual improvement.
Concluding his address, CJI Khanna called for a united effort to make the legal profession more inclusive and sustainable, quoting Martin Luther King Jr.: "Everyone can be great because everyone can serve."
The event underscored the urgent need for systemic reforms to secure the future of litigation and ensure access to justice for all.
