DECISION OF THE BOMBAY HIGH COURT {POSCO ACT} “MINOR’S CONSENT HAS NO VALUE IN THE EYES OF LAW”



It was informed by the appellant to the Bench of Justice VM Deshpandey and Anuja Prabhu Desai that the couple had a love affair and sexual intercourse by mutual consent. Later, after examining the charge sheet, the court concluded that the girl had no any affection for the boy and that the boy had threatened the girl, due to which the girl agreed to go with the boy. Thus, taking into account the statement of the survivor, the court did not applied the power to release the accused. The court understood from the victim’s school leaving certificate that she was a minor.

The contention is that the appellant had no roots in the Maharashtra and perhaps that is why the court had made up its mind to dismiss the petition.
