'Even While Dissenting, One Must Be Respectful': SC on RJD MLC's Plea

The Supreme Court of India emphasized the need for respectful dissent during a hearing on a plea filed by a Rashtriya Janata Dal (RJD) Member of the Legislative Council (MLC) challenging his expulsion over remarks made against Bihar Chief Minister Nitish Kumar.


The MLC, whose identity remains undisclosed, was expelled from the party for allegedly making disparaging comments about Kumar’s leadership and policies. The plea before the apex court argued that the expulsion violated his freedom of speech and expression under the Constitution.


During the hearing, the bench observed, "Dissent is a cornerstone of democracy, but even while dissenting, one must be respectful." The court stressed that political discourse should maintain decorum, ensuring that criticism does not devolve into personal attacks or disrespect.


The MLC’s counsel contended that the expulsion was a disproportionate response and sought judicial intervention to restore the MLC's party membership. The RJD, however, defended its decision, stating that the remarks undermined party unity and discipline.


The case raises critical questions about the balance between free speech and party discipline in a democratic framework. The court has reserved its judgment on the matter, urging political parties to foster environments where healthy criticism can coexist with mutual respect.
