Kapil Sibal Praises CJI Chandrachud’s Bold Stance on Complex Legal Issues and Legacy

At a farewell event organized by the Supreme Court Bar Association (SCBA) on Friday, SCBA President Kapil Sibal praised Chief Justice of India DY Chandrachud for his fearless approach in addressing complex issues that previous CJIs may have avoided. Sibal highlighted Chandrachud's commitment to tackling cases involving Article 370, same-sex marriage, and electoral bonds, calling it an unprecedented step in the judiciary's role in shaping India's constitutional landscape.


"Past Chief Justices would not allow themselves to deal with those issues for years,” Sibal said, commending Chandrachud for his courage to confront topics that fundamentally impact the nation. He noted the Chief Justice's unique clarity in handling these complex cases, which redefined the boundaries of Indian jurisprudence.


Sibal, who has argued before both CJI Chandrachud and his father, former CJI YV Chandrachud, praised the current CJI for surpassing his father’s legacy. He emphasized Chandrachud's dedication to upholding life, liberty, and equality as foundational values, underlining that his judgments consistently defended citizens’ rights. According to Sibal, CJI Chandrachud’s rulings showcased a commitment to safeguarding these principles and a willingness to venture into unexplored legal territory, setting a new benchmark for judicial accountability and transparency.


Chandrachud’s initiatives in disability rights and transparency within the judiciary were also highlighted. Sibal recognized him as a "trailblazer" for promoting inclusivity and welcoming public accountability, including allowing criticism of judicial proceedings. He lauded the CJI’s openness to increasing citizens’ access to court processes, enabling public scrutiny and encouraging a forensic examination of justice delivery.


Sibal acknowledged the challenges ahead, especially as technology reshapes law. He praised CJI Chandrachud’s judgments on privacy rights, including his landmark dissent on Aadhaar, calling it a progressive stance on individual dignity. In closing, Sibal paid tribute to Chandrachud’s enduring legacy, affirming that his contributions to law and society will resonate well beyond his tenure.
