SC orders various institutions to establish complaints committees for reporting sexual harassment

On Thursday, A bench of Justices S Ravindra Bhat and Dipankar Datta mandated that internal complaints committees be established by hospitals, nursing homes, sports institutions, stadiums, sports complexes, competitions, or game venues in order to report instances of sexual harassment that occur at work and stated that central government may consider the amendments in POSH Rules designate a department and establish a "nodal person" position within that department to be in charge of the coordination needed to carry out the Act. The court added that This will guarantee more consistency in the Act's application throughout the nation.


The ruling on a PIL filed by the non-governmental organization Initiatives for Inclusive Foundation asked the federal government and each state to take action to put the Sexual Harassment at Workplace (Prevention, Prohibition and Redressal) Act, 2013—which includes the POSH Rules—into effect.


The bench mandated that the Central Government receive a consolidated report from all States and Union Territories attesting to their compliance with the court's orders within eight weeks.


Within 12 weeks of the judgment date, the Centre was ordered to compile all of the reports, find any instances where the State had failed to comply, and attempt to address them before filing a consolidated affidavit of compliance outlining the States' compliance and the Union Government's response to the directives.


In its ruling, the Court gave various instructions for the improved application of the POSH Act.

Every State's or UT's Ministry of Women and Child Development should think about designating a "nodal person" inside the Department to supervise and support coordination as suggested by the POSH Act.


Establishing ICs and reporting compliance per this Act's obligations is required of hospitals, nursing homes, sports complexes, stadiums, and competition or game venues.


Local complaint committees must submit their information to the designated district officers within the State Government within six weeks after the ruling, and the designated district officers are responsible for securing these nodal officers' contact data, etc.


The matter will be heard again in February 2024.
