While addressing the nation at the International Lawyer's Conference 2023, Justice JK Maheshwari, honourable judge of the Apex Court, delivered some productive insights about the footprints of social media and how it turned the table for the legal system gradually and progressively.


He highlighted the view that social media can be perceived from three standpoints: positive, negative, and balanced. Each standpoint has its own references and connections and plays a significant role in the legal section and association at a broader stage. While addressing further, he delivered the following:


Profound Effects:

Social media acts as a chain in the legal community, which makes sure that both lawyers and judges can identify themselves with society and deliver a better view of the social dynamics and parities engrossed in society.


Social media also acts as a gadget, which clears all the complexity prevailing in society and assures that all the legal information reaches every door.


It also provides a very convenient passage through which access to information stretches itself out to every place, despite any geographical problems.


Positive Instances:

Just as in the Nirbhaya rape case, social media played a very dominating role in creating awareness, which ultimately led to changes in the provision of law.


Also, during the COVID-19 pandemic, social media played a very crucial role by showcasing the irregularities in society along with the command of law.


Sushant Singh Rajput Case: social media transformed the legal processes and created a nexus for media coverage over sensitive matters.


It was social media that made the working of e-courts very convenient during the pandemic, which helped in handling the cases efficiently.


Adverse Effects:

Social media creates anti-biassed narratives in the minds of legal professionals based on incomplete information.


Also, it leads to trolling and criticism as individuals with false or incomplete data question the functioning of the legal system, which eventually disrupts public opinion.


Social media also adversely affects the decision-making process of judges, as they can be introduced to business while making decisions because they may get influenced and align their ideas with those of the public.


Negative Instances:

As was seen in the case of the Gyanvapi Mosque, social media created a communal hatred in the minds of the people, dismantling the essence of brotherhood as different communities interpreted events differently, which hence created a threat to judges, and because of which interference by the apex court worsened the situation.


Balanced or Equilibrium Impact:

The live streaming feature of social media can lead to quick responses to any crisis. Just as in the incident that happened in Manipur, which resulted in very harsh violence between the two communities, it was social media only through which videos and evidence of the protests were shared thoroughly and helped the victims get justice in quick instances.
