“SORRY STATE OF AFFAIRS”: Calcutta High Court slams West Bengal Government over RG Kar Medical College Vandalism

The recent case of brutal murder and potential rape of a female resident doctor at RG Kar Medical College Calcutta has led to massive protests and outrage in the country. While taking up the matter regarding vandalism that occurred on the night of 14 August, the Calcutta High Court reacted sharply against the West Bengal Government. It raised some serious questions about the measures taken by the Police Department to protect the crime scene.


The plea was heard by a division bench of Chief Justice TS Sivagnanam and Justice Hiranmay Bhattacharya on 16 August 2024.


Background

A horrifying incident took place, where a female resident doctor of RG Kar Medical College was raped and murdered while being on night duty in the institute’s premises on August 9, 2024. Following this, a nationwide uproar and protest are being held by the medical community. The doctors from several hospitals have called for an indefinite strike and demanded for immediate action for the matter.


Various cases have come to light which show lack of facilities such as rest areas, good working conditions and a safe environment are some common problem the medical community faces.


A large number of women took to the streets of Kolkata for the ‘Reclaim the Night’ protest demanding justice for the 31-year-old trainee doctor. However, a mob stormed the hospital during the protest which led to the destruction of the property of the hospital, attempting to destroy evidence.


Current development

While hearing multiple pleas on the matter the Calcutta High Court questioned the lack of safety measures taken by the police to protect the crime scene.


The state argued that the sudden entry of a mob of 7000 people led to the breaking of barricades and injury to several policemen. The Hon’ble Court slammed the intelligence wing of the police, stating that 7000 couldn’t come by walking and it's hard to believe that police had no idea about it.


The court further grilled the government to put section 144 in effect for any reason, but not for this time. It noted that although the crime scene was saved but the safety of doctors and staff working is in question. Calling it a ‘complete failure of state machinery’, the Court expressed concern over of safety of doctors working there. ‘If police cannot protect their men, how can doctors work fearlessly?’ the court asked. It further warned to close down the hospital and shift the patients.


The court has instructed the police to provide a separate affidavit by 21 August 2024. The matter has been handed over to CBI for investigation. The court further directed the CBI to submit an interim report on their progress in this case.


The criticism and concern by the Calcutta High Court highlighted the need for immediate action by the state government to ensure the safety of the doctors. The Court’s order emphasized the responsibility of the state government to provide a safe environment for healthcare personnel to work without any fear.
