Supreme Court Criticizes Centre for Lack of Representation in Key Cases

The Supreme Court of India recently expressed concern over the frequent absence of government counsel in crucial cases involving the Union of India. During a hearing, the bench observed that despite having a large panel of legal representatives, the Centre often fails to ensure their presence in court proceedings, leaving the Union unrepresented on several occasions.


The court pointed out the repeated absence of counsel as a significant issue that disrupts judicial efficiency and delays justice. The bench highlighted that such lapses adversely impact the government’s ability to present its stance on critical matters, potentially leading to adverse outcomes.


The remarks came during a case where the Union of India was a respondent, but no representative appeared to defend its position. The court stressed that it is imperative for the Centre to address this issue by ensuring proper coordination and accountability among its legal representatives.


The Supreme Court emphasized that having a robust panel of legal counsels is futile if their presence in court cannot be ensured. It urged the Centre to take immediate corrective measures to prevent such occurrences in the future, as they reflect poorly on the government’s commitment to legal processes.


The criticism comes at a time when the judiciary has been vocal about administrative inefficiencies and procedural delays. This incident adds to the growing concerns about the need for systemic reforms to enhance the effectiveness of legal representation in government cases.


The court concluded its remarks by reminding the Centre of its responsibility to maintain the dignity of the judicial process and ensure timely representation in all matters.
