Supreme Court Denies Bail to Accused in 2020 Bengaluru Riots, Orders Additional NIA Court


In a significant ruling, the Supreme Court of India has denied bail to individuals accused in the 2020 Bengaluru riots case, emphasizing the seriousness of the charges under the Unlawful Activities (Prevention) Act (UAPA). The court also directed the Karnataka government to establish an additional NIA (National Investigation Agency) court to expedite trials in UAPA-related cases.


The 2020 Bengaluru riots, which erupted in DJ Halli and KG Halli areas, led to large-scale violence, destruction of public property, and attacks on police stations. Several individuals were arrested under the UAPA for their alleged involvement in the violent protests.


During the hearing, the accused sought bail on the grounds of prolonged detention and procedural delays. However, the Supreme Court dismissed these arguments, stating that UAPA offences involve national security concerns and require a stricter approach in bail considerations. The bench emphasized that the gravity of the allegations, including rioting, arson, and destruction of government property, warranted continued custody.


Further, the apex court acknowledged the increasing backlog of UAPA cases in Karnataka, particularly in Bengaluru, and ordered the state government to set up an additional NIA court. The move aims to ensure speedy trials and prevent undue delays in justice delivery.


Legal experts believe this decision reinforces the judiciary’s firm stance on national security-related cases while also addressing judicial pendency in special law matters. The Karnataka government is now expected to act swiftly in establishing the new court to comply with the Supreme Court’s directives.


This ruling underscores the judiciary’s commitment to handling UAPA cases with strict scrutiny and ensuring timely legal proceedings in sensitive cases involving national security concerns.
