Supreme Court Ensures Inclusive Toilet Facilities in Court Premises for All

The Supreme Court of India has issued significant directions to ensure the availability of accessible and inclusive toilet facilities within court premises for women, persons with disabilities, and transgender individuals. This landmark move emphasizes the judiciary's commitment to upholding the principles of dignity and equality for all.


The bench, acknowledging the long-standing infrastructural inadequacies in court complexes across the country, stated that the absence of proper sanitation facilities disproportionately affects marginalized groups, especially women, disabled persons, and transgender individuals, thereby infringing upon their fundamental rights.


The court has directed all state governments and the Union Territories to conduct an immediate assessment of existing facilities and submit detailed reports within a stipulated time. Authorities are required to implement measures to construct, upgrade, and maintain hygienic, accessible, and gender-inclusive toilets in all court premises.


Emphasizing the importance of accessibility, the bench highlighted the need for compliance with the Rights of Persons with Disabilities Act, 2016. Court complexes must incorporate disabled-friendly features such as ramps, handrails, and adequate space in restroom designs to accommodate wheelchair users. For transgender persons, the court emphasized the inclusion of separate and dignified sanitation facilities to align with their right to equality under Article 14 of the Constitution.


The Supreme Court's directives come after multiple representations and reports highlighted the lack of basic amenities in court premises, particularly in smaller towns and rural areas. These measures aim to address systemic gaps and ensure that no individual faces barriers in accessing justice due to inadequate infrastructure.


The apex court also underscored the need for periodic audits of court premises to monitor the functionality and maintenance of these facilities, thereby promoting long-term sustainability.

This progressive step by the judiciary sets a precedent for other public institutions to follow, reinforcing the ideals of inclusivity and equal access to public spaces for all citizens.
