Supreme Court Grants Bail in UAPA Case, Criticizes Chhattisgarh Police for Misuse

The Supreme Court has granted bail to an accused in a case under the Unlawful Activities (Prevention) Act (UAPA), observing that the law was deliberately applied to circumvent its earlier order granting interim protection. The bench condemned the Chhattisgarh police for misusing stringent anti-terror laws to suppress individual rights and evade judicial directives.

The Court stated that invoking UAPA in a manner intended to defeat a Supreme Court order undermines the rule of law and constitutional safeguards. It warned law enforcement agencies against arbitrary use of such stringent laws for extraneous purposes.

This ruling reaffirms the judiciary's commitment to preventing the misuse of anti-terror laws and upholding fundamental rights. Legal experts view it as a significant step in ensuring that stringent legal provisions are not weaponized to curtail personal liberty or override judicial protection. The decision is expected to influence future cases involving alleged misuse of UAPA by authorities.
