Supreme Court Grants Regular Bail to Hyderabad Businessman Abhishek Boinpally in Delhi Liquor Policy Case

The Supreme Court on October 14 granted regular bail to Hyderabad businessman Abhishek Boinpally in connection with the Delhi Liquor Policy case. The bench, comprising Justices M.M. Sundresh and Aravind Kumar, granted bail on grounds of parity with other accused persons. Boinpally had been on interim bail since March 20, which had been periodically extended, most recently on August 13 for two months.


Boinpally’s plea for permission to travel freely within the country, raised by senior advocate Vikram Chaudhary, was left for the trial court's consideration. The Supreme Court clarified that the travel restrictions previously imposed were only applicable during the interim bail period.


The regular bail plea was filed as a special leave petition challenging the Delhi High Court's July 2023 judgment, which had denied him bail. The High Court had upheld the Special Judge's ruling, which cited the gravity of the allegations and the presence of credible evidence against Boinpally as reasons for refusal. The allegations against him involved his role as a representative of the "South Group" in a cartel linked to kickbacks and their recoupment under the Delhi Liquor Policy.


Boinpally, a former director of Robin Distilleries LLP, was initially arrested by the Central Bureau of Investigation (CBI) in October 2022. While he was granted bail shortly after his arrest, his relief was temporary, as the Enforcement Directorate subsequently secured an order for his custody. His efforts to secure bail from the Special Court and Delhi High Court proved unsuccessful due to the seriousness of the charges.


The Delhi Liquor Policy case involves several high-profile accused, including former Chief Minister Arvind Kejriwal, former Deputy Chief Minister Manish Sisodia, and Bharat Rashtra Samithi leader K Kavitha, who have also secured bail from the Supreme Court.


The case, titled Abhishek Boinpally v. Directorate of Enforcement (Special Leave Petition (Criminal) No. 9038 of 2023), has seen significant developments as the investigation progresses. Senior Advocate Vikram Chaudhary appeared for the petitioner, while Additional Solicitor General S.V. Raju represented the Directorate of Enforcement.
