The Supreme Court has stayed the Punjab & Haryana High Court's directive for the construction of a verandah at the High Court premises. The decision came in response to objections raised by the Chandigarh Administration, which highlighted concerns over the site's status as part of the UNESCO World Heritage Site – “The Architectural Work of Le Corbusier.”
A Bench led by Chief Justice of India, while issuing the stay, acknowledged the significance of preserving the architectural heritage of the iconic Capitol Complex, designed by renowned architect Le Corbusier. The High Court had previously directed the construction of a verandah, citing functional requirements, but this sparked opposition from the Chandigarh Administration. The administration argued that such alterations could jeopardize the site's heritage status under UNESCO's stringent conservation guidelines.
The Chandigarh Administration contended that the Capitol Complex, encompassing the Punjab & Haryana High Court, the Secretariat, and the Legislative Assembly, is a globally recognized architectural masterpiece that demands meticulous preservation. Modifications, even for practical purposes, could lead to delisting by UNESCO, tarnishing its heritage value.
In its order, the Supreme Court emphasized the need to balance functional necessities with the preservation of cultural and architectural heritage. It directed a detailed examination of the matter, involving expert bodies such as the Indian National Trust for Art and Cultural Heritage (INTACH) and UNESCO representatives, to ensure any proposed changes align with heritage guidelines.
The stay order is seen as a significant intervention in safeguarding India's architectural legacy while addressing operational concerns. The matter will next be heard on a date to be decided by the Supreme Court.
