Supreme Court Issues Notice on Plea Challenging Bihar Public Service Commission Chairperson’s Appointment

The Supreme Court of India has issued a notice to the Bihar government in response to a plea challenging the appointment of the Chairperson of the Bihar Public Service Commission (BPSC). The petition questions the legality and selection process of the appointment, alleging procedural irregularities and non-compliance with constitutional and statutory provisions.

A bench headed by the Chief Justice of India (CJI) took cognizance of the matter and sought a response from the Bihar government, directing it to clarify its stance on the allegations. The plea argues that the appointment violated Article 316 of the Constitution of India, which governs the conditions and tenure of members of a Public Service Commission.

The petitioner contends that the selection process lacked transparency, fairness, and adherence to established criteria, which could undermine the independence and efficiency of the Commission. Furthermore, it is alleged that the appointment was made in violation of the principles of merit and suitability, raising concerns over the commission’s ability to discharge its constitutional mandate effectively.

The Supreme Court’s intervention comes at a crucial time when public service recruitment in Bihar has been a subject of scrutiny and debate. The outcome of this case could have far-reaching implications on the governance and functioning of state public service commissions across India.

The Bihar government is expected to file its response in due course, justifying the appointment process. The next date of hearing will be decided after the submission of replies by the concerned parties.

This case is being closely watched by legal experts, aspiring candidates, and policymakers, as it raises important questions about transparency and accountability in public service appointments. The Supreme Court’s decision in this matter will likely set a precedent for similar disputes in the future.
