Supreme Court Clarifies National Permit Validity Amid Non-Payment of Authorization Fee
In a significant ruling, the Supreme Court of India has held that non-payment of the authorization fee while a vehicle remains in its registered state does not invalidate its national permit. The judgment provides clarity on the Motor Vehicles Act, 1988, ensuring that transport operators are not penalized with permit invalidation for failure to pay the fee when their vehicle has not left its home state.
The case arose when transport authorities penalized a vehicle owner for non-payment of the authorization fee, leading to a dispute over whether such non-compliance automatically voids the national permit. The Supreme Court, however, ruled that while paying the fee is a statutory requirement, non-payment does not result in immediate permit cancellation unless the vehicle is found operating outside its registered state without authorization.
The bench emphasized that authorization fees are regulatory in nature and do not determine the validity of a national permit itself. It clarified that while penalties or fines can be imposed for non-payment, complete invalidation of the permit would be disproportionate and unfair to transporters, particularly when their vehicles have remained within the registered jurisdiction.
