Supreme Court Rebukes UP Prison Secretary for False Affidavit, Warns of Contempt Action

The Supreme Court of India on Tuesday, August 27, 2024, delivered a stern rebuke to the Principal Secretary of the Prison Administration and Reforms Department of Uttar Pradesh, Rajesh Kumar Singh, for submitting a false affidavit regarding the progress of a remission plea of a convict. The Court condemned Singh for altering his statements to suit the convenience of his superiors, asserting that such behavior would not be tolerated.


A bench comprising Justice Abhay Oka and Justice Augustine George Masih expressed serious concern over the inconsistencies between Singh's affidavit and his earlier statements. The Court highlighted that Singh initially claimed that the Chief Minister's Secretariat delayed processing the remission file due to the Model Code of Conduct (MCC). However, in a subsequent affidavit, Singh contradicted himself, attributing the delay to the Standing Counsel for UP not communicating a May 13, 2024, court order. This order had explicitly stated that the MCC would not impede the decision-making process on the remission plea.


Justice Oka, in oral remarks, emphasized the gravity of the situation, suggesting that without appropriate action against the officer, such misconduct would continue. He stated, "Some officer must go to jail; otherwise, this will not stop… Unless you take action against this man, we are not going to spare him. The state must take action."


The Court had previously warned Singh of possible contempt proceedings and permitted him to submit an additional affidavit to clarify his position. However, Singh maintained that his earlier statement regarding the CM Secretariat's inaction was due to a communication gap during his virtual appearance in court.


The case underscores the judiciary's insistence on accountability and integrity within the administrative machinery, particularly when it comes to legal proceedings and interactions with the Court.
